Unfortunately, our Denia representative was unable to reclaim the 3% retention, kept this information from us, and failed to keep her word regarding information and timescale. She is no longer responding to requests for updates. It appears that our only recourse to recoup the €4.5K (now 5 years overdue) from the Spanish fiscal authorities is to initiate civil proceedings, as we are out of time to make a claim from them. There is no legal requirement in Spain that you must employ a lawyer for such matters. Having a legally qualified lawyer to advise you on legal matters ensures that your interests are protected by a professional who is accredited, certified, and adequately covered. In Spain, it is permissible to represent oneself in court proceedings up to €2,000. However, having someone knowledgeable in the rules of the game can often make a decisive difference between a successful outcome and failure.
