Solicitors are usually considered trustworthy. Unfortunately, our Denia representative was unable to reclaim the 3% retention, kept this information from us, and failed to keep her word regarding information and timescale. She is no longer responding to requests for updates. It appears that our only recourse to recoup the €4.5K (now 5 years overdue) from the Spanish fiscal authorities is to initiate civil proceedings, as we are out of time to make a claim from them.

We welcome your suggestion on a lawyer to take care of the claim or any other alternatives available.

You do not need to go to court or a tribunal for matters that do not require it. I have not indicated that legal representation is mandatory for extrajudicial matters under Spanish Law. In Spain, you can handle all your legal matters without the need for a professional. Some people opt to represent themselves in the same way that they may engage in self-hair cutting or gardening.

 

If you are seeking to apply for a visa, or residence permission, make a will, complete a tax return, or purchase property in Spain, engaging the services of a Spanish Solicitor is not necessary. There is no legal requirement in Spain that you must employ a lawyer for such matters.

 

Having a legally qualified lawyer to advise you on legal matters ensures that your interests are protected by a professional who is accredited, certified, and adequately covered.

 

In Spain, it is permissible to represent oneself in court proceedings up to €2,000. However, having someone knowledgeable in the rules of the game can often make a decisive difference between a successful outcome and failure.

 

A licensed lawyer must represent you in most court cases to ensure that your interests are properly represented by a professional who has studied law for five years and gone through an apprenticeship before being able to advise clients.

 

If you opt to use a lawyer, there is a wide range of available options. Make sure you have the contact information for them so you can verify that they are qualified to practice.
