Who needs to declare rental income to the Tax office? I am inquiring if the rental income is subject to income tax. One of us is in a higher tax bracket than the other. So, if you are a non EU resident - you need quarterly fill and submit IRNR form - modelo 210, the tax that you need to pay is 24%. If you are an EU resident - it is 19%. If you are Spanish resident - you need to include the income from rent (deducting IBI, municipal taxes, etc) to the annual IRPF declaration.
